Terms and conditions
The terms and conditions will apply to all sales of goods by Coral Farm Reef S.R.L., through the online warehouse www.coralfarm.ro to the buyer.
TERMS AND DEFINITIONS
Coral Farm (CORAL FARM REEF S.R.L.) reserves the right to revise the General Terms and Conditions presented in this section at any time and without prior notification to users. The terms and conditions of use in force are those displayed on the site and will apply to everyone.
Accessing or visiting the website, any of its pages, as well as placing an order constitutes full and unconditional acceptance of the Terms and Conditions and any of their provisions.
Logging/Authentication through a social network: Google+ or Facebook - represents an acceptance of the Terms and Conditions.
The terms used will have the following meaning:
Buyer/User – natural person / legal entity or any legal entity that creates an Account on the Site and/or places an Order. In this act, the buyer is also called the client.
Consumer - any natural person or group of natural persons constituted in associations, who, within the contracts falling under the scope of this law, act for purposes outside of their commercial, industrial or production, craft or liberal activity;
Seller - is the commercial name of CORAL FARM REEF S.R.L., a legal entity of Romanian nationality, with its registered office in Com. Chiajna, Str. Head. Dumitru Calin, no. 16, Jud. Ilfov, having order number in the Trade Register J23/3141/2015, unique tax registration code 36707976, otherwise known as CORAL-FARM.
Goods, Goods and Services - any goods/product and/or service, including the services and documents mentioned in the Order, to be provided by the Seller to the Buyer as a result of the concluded Contract.
Order – an electronic document that intervenes as a means of communication between the Buyer and the Seller through which the Buyer conveys to the Seller, through the Site, his intention to purchase Goods, Goods and/or Services found on the Site.
Contract - represents the agreement made at a distance between the Buyer and the Seller, without the need for the parties to appear, respecting the general terms and conditions of this document. THESE TERMS AND GENERAL TERMS, IMPLIEDLY ACCEPTED BY THE BUYER, ARE AN INTEGRAL PART OF THE CONTRACT THAT ARISES AS A RESULT OF THE REGISTRATION OF AN ORDER. By submitting the order, the customer is contractually committed to purchase the ordered products. The contract is considered concluded when the seller sends the customer's order confirmation message.
Campaign - means by which a certain limited amount of Products, Goods and/or Services is presented for commercial purposes, for a limited period of time and established by the Seller.
Content
- the completeness of information of general interest published on the website www.coralfarm.ro, which can be viewed and accessed using an electronic device
- the content of any e-mail sent to Buyers by the Seller through electronic resources and/or any other available means of communication;
- any information communicated by any means by an employee/collaborator of the Seller, the Buyer, according to the contact information, specified or not by him
- information related to the Goods and/or Services and/or the rates applied by the Seller in a certain period;
- information related to the Goods and/or Services and/or rates charged by a third party with whom the Seller has concluded partnership contracts, during a certain period;
- data related to the Seller, or other privileged data of him.
The technical (commercial) warranty is the warranty offered by the electronics manufacturer and generally copied by the seller. There is no minimum technical warranty period. If it breaks or you have problems, this is the criterion on the basis of which the products are repaired or replaced.
The guarantee of conformity is the guarantee offered by the seller, according to the legislation in force. It is a maximum period of 2 years for durable goods, products with a shorter operating period can obviously have a shorter guarantee Art. 16-2. This warranty is the one through which the seller guarantees you that the product sold is in accordance (not functional) with the specifications that he promised to sell. This guarantee is independent of the technical guarantee and does not cover technical defects.
- LIMITATION OF RESPONSIBILITY Coral Farm Reef S.R.L.
2.1. The notification received by the Buyer, after placing the Order, has the role of information and does not represent the acceptance of the Order. This notification is made electronically (e-mail) or by telephone
2.2. For justified reasons, the Seller reserves the right to change the quantity of Goods and/or Services in the Order. If he changes the quantity of Goods and/or Services in the Order, he will notify the Buyer at the e-mail address or at the telephone number provided to the Seller when placing the Order, before making the delivery in the case of acceptance of the new quantity, or will return the amount paid in the case the refusal for the new quantity.
2.3. The contract is considered concluded between the Seller and the Buyer at the moment the Buyer receives from the Seller, via e-mail and/or SMS, the notification of dispatch of the Order.
2.4. For Orders registered by the Buyer, orders to be shipped to the CORAL-FARM showroom and delivery points, the prices and/or reservations of Livestock, Goods and/or Services remain valid for only 24 (twenty-four) hours.
2.5. CORAL - FARM is not responsible and cannot be held responsible for errors, inaccuracy of the information published/maintained on the site, which are not attributable to it. Users will find detailed information in the CORAL FARM store.
2.6. If the prices or other details of the products/promotions have been displayed and/or entered into the database in error, CORAL FARM reserves the right to cancel a certain order and to inform the customer as soon as possible about the error ( if the product has not yet been delivered).
2.7. The details/characteristics of the goods found on the SITE are taken over and made available by the supplier/producers and CORAL FARM does not assume responsibility for the accuracy of this information.
2.8. The prices of goods, products and services are purely informative and may undergo unannounced changes at any time.
2.9. If the period of the promotion is not specified, the prices of goods, goods and services that are part of the promotion are valid within the limit of available stocks. The prices in the CORAL FARM store may be different from those displayed on the website www.coralfarm.ro, so orders registered online for goods, food and services at a lower price than the one displayed in the store, remain valid and will be delivered in the order of registration of orders on the website and according to the limit of available stock.
2.10. CORAL-FARM reserves the right to supplement and modify any information on the SITE.
2.11. The stock of products sold by the online store www.coralfarm.ro that bears the mention "In stock supplier" - the product is in the supplier's offer and theoretically in his stock. The stock check at the supplier is done by a sales agent after receiving the order, within a maximum of 72 working hours from the moment of receiving the order. Considering that the updating of the supplier's stocks is not done in an interval that allows accurate information, there may be cases in which a product displayed in the supplier's stock is no longer actually in stock. There is also the possibility that these products can be brought only by special order, with delivery times from 5 days to 60 days. The information being taken from the supplier, we do not assume responsibility if the respective product is not in his stock.
2.12. For products that bear the mention "In stock supplier" an advance payment of at least 25% of the value of the product or the entire order can be requested.
2.13. There may be situations when on the website www.coralfarm.ro a product appears "In stock" but it is not physically in the stock of our warehouse, in these cases, the customer will be notified of an estimated delivery time according to the procedure from point 2.11.
- RIGHTS AND OBLIGATIONS OF THE SELLER
3.1. CORAL FARM is not and cannot be held responsible for any additional costs paid by the buyer, including currency conversion fees charged by banking institutions.
3.2. Certain products displayed on the SITE are for example, and the shipped products may differ from the images due to changes in specifications and/or design, unannounced by suppliers/manufacturers.
3.3. The payment methods for completing online orders are: cash on delivery, online with bank card, payment order. Payment made online with the bank card does not ensure the confirmation and shipment of the products in the order. If the order is not confirmed within 72 (seventeen) hours, the amount paid will be returned to the customer's account as soon as possible.
3.4. If the Seller cannot deliver the order of a good, life and/or service to the Buyer, the Seller will notify the Buyer about this fact and return to the Buyer's account the counter value of the good/life and/or service within a maximum of 7 working days, starting with the date on which The Seller became aware of this fact or from the date on which the Buyer expressly expressed his intention to terminate the Contract
3.5. Registering the order does not equate to a confirmation of it. After receiving the order, it will be processed by Coral Farm to be able to confirm it and determine the delivery terms. The delivery time is 24-72 hours from the confirmation of the order, unless otherwise ordered.
3.6. The preparation and packaging of parcels containing live animals will be done by Coral-Farm in special containers to ensure the best possible quality of the transport, by using additional measures and environments that increase their safety during transport.
3.7. The Seller may cancel the Buyer's Order, after prior notice to the Buyer, without any subsequent obligation of either party to the other or without any party being able to claim damages from the other in the following cases:
- a) non-acceptance by the issuing bank of the Buyer's card, of the transaction, in the case of online payment;
- b) invalidation of the transaction by the card processor approved by CORAL-FARM, in the case of online payment;
- c) the data provided by the Client/Buyer on the Site are incomplete and/or incorrect;
- RIGHTS AND OBLIGATIONS OF THE CLIENT
4.1 The customer has the right to notify the seller in writing of the defects or irregularities observed, and may request the replacement of the goods, goods and services, either with an identical or similar one, when it is in stock, or the counter value of the product in the form of a shopping check in the Coral Farm store , only in one of the following situations:
- a) if the request is made upon opening the package and through photographs showing the advanced stage of damage to the goods and/or living things or the death of living things.
- b) when the delivery term is respected and confirmed by Coral-Farm, starting with the time the parcel is dispatched and until its receipt.
- c) when the package is in a good state of preservation.
4.2 The customer has the obligation to attach photos of the property or the damaged or dead animal in the closed bag without it being opened, without introducing the aquarium in the case of live animals, in order to photograph any irregularities found. The lack of this photo and failure to comply with the complaint deadline (see point 5.2) after receiving the parcel leads to the nullity of the complaint.
4.3 Any type of delay due to force majeure clauses and/or the customer's absence from home and/or damage to the parcel due to the carrier without it being insured, invalidate any claims and implicitly the conditions of return or reimbursement.
4.4 If the Buyer/Client requests withdrawal from the Contract, within the terms and conditions presented in this document, he must return the claimed product as well as the related gifts (if applicable) that accompanied the order. The Seller will return the amount within 14 (fourteen) working days at most from the date of receipt of the product returned by the Buyer. The amount will be returned as follows:
- a) for Orders paid by online card -> by return to the account from which the payment was made;
- b) for Orders paid with Op/reimbursement/Bank card-> by bank transfer;
4.5 The consumer has the right to notify the merchant in writing that he is canceling the purchase, without penalties and without citing a reason, within a maximum of 14 days from receiving the product.
The returned product must be in the same condition in which it was delivered (in original packaging, with all accessories, with intact labels and accompanying documents). The costs of returning the products will be borne by the consumer and the reimbursement of the product value will be made within 14 days of the return at most. Refunds are made only to the customer's IBAN account specified in the return form.
Cash on delivery parcels are not accepted.
All returned products must be:
- in perfect condition, without visible signs of use
- with the original labels and in the original packaging
- with all related accessories
- the original warranty certificate
- accompanied by the return form completed and signed by the owner of the product
If the product is returned in a condition where it can no longer be sold as new, we reserve the right to request a return fee (if possible) or to cover the price difference resulting from the sale of the product as second hand -hand.
THE FOLLOWING PRODUCT CATEGORIES CANNOT BE RETURNED: Products that show physical changes, bumps, chips, scratches, shocks, bends or that come into contact with water or any chemical substances, etc.
THE FOLLOWING CATEGORIES OF PRODUCTS CANNOT BE RETURNED (their return is not accepted) are listed as examples, without limiting ourselves to the following (according to art. 16 OUG 34/2014): Special order products, regardless of category, brought into stock in following a firm order from you and/or payment in advance, they cannot be returned.
MARINE OR FRESHWATER LIFE INTRODUCED IN THE AQUARIUM CANNOT BE RETURNED!
The costs of returning the products will be borne by the customer, the customer will pay the shipping fee to the courier at the time of sending the package.
REFUND PARCELS ARE NOT ACCEPTED!
4.6 By creating the Account and/or using the Content and/or placing the Orders, the Client/User/Buyer expressly and unequivocally accepts the Terms and Conditions of the Site in the latest updated version that is communicated within the Site, existing on the date of creation Account and/or use of the content and/or on the date of placing the Order
- THE TERM FOR ISSUING AND/OR TRANSMITTING THE COMPLAINT
5.1. The complaint is made immediately after receiving the package and after opening and finding irregularities.
5.2. For live animals - after receiving and opening the package, the buyer has 3 hours to issue a complaint, before the animals have been introduced into the aquarium.
5.3. Coral-Farm is not responsible for the damage and/or death of corals, plants or animals after their introduction into the customer's aquariums, losses that may be due to the conditions to which they are subjected, nor for any type of complaints regarding subsequent consequences that may occur in the aquarium after the introduction and/or treatment of living things.
5.4. In case of fulfillment of the above listed, please contact us in writing by email: contact@coralfarm.ro and you will be contacted to establish the method of return and reimbursement of the counter value of the products. The value of the products can only be consumed in the Coral Farm store and is not returned in the form of money in the case of live animals.
5.5. For the resolution of the complaint, the term is a maximum of 30 working days from the moment of confirmation by email or phone of the receipt of the complaint.
- TRANSPORT AND DELIVERY
6.1. Preparation for the delivery of your order is made only after verification and confirmation of payment. The delivery terms communicated by Coral-Farm at the time of payment confirmation are of an informative nature, and may undergo subsequent changes depending on factors beyond Coral-Farm's control. In cases of force majeure, strikes, epidemics, wars, natural disasters, transport interruptions or delays, the impossibility of finding the necessary materials on the market, legal measures that block, limit or cause delays in the production and/or import of products, Coral- Farm is not responsible for non-compliance with the previously established delivery deadline.
6.2. Transport costs will be calculated according to the total weight of the package and the packaging method. Shipping costs are borne by the customer. The goods can be insured against damage or losses suffered during transport, with the courier company according to the conditions and fees charged by it. If the packaging is damaged, accept the delivery only after opening the parcel and packaging, in the presence of the courier. After signing the receipt certificate, complaints regarding the transport, which result in damage to the contents, are no longer taken into account.
6.3. The costs of storage and preparation for transport for livestock can vary depending on the quantity ordered, starting from 8 lei/box.
- CONFIDENTIALITY
7.1. The information provided by the buyer/client to Coral-Farm will remain the property of the latter.
7.2. They will not be disclosed to third parties and will be used strictly for the purpose for which they were presented.
7.3. When placing each order, the customer gives his consent for his personal data to be used for commercial and administrative purposes, according to data privacy laws.
7.4. The website and all its contents (texts and images) are owned and copyrighted by Coral Farm Reef S.R.L. or www.coralfarm.ro with all rights reserved. It is strictly forbidden to use any Content without the written permission of the owner. We inform you that Coral Farm Reef S.R.L. will take all the necessary steps to ensure and recognize intellectual property rights in accordance with the laws in force, calling, if necessary, to prosecute those guilty of intellectual property rights violations in criminal courts.
- DISPUTES
8.1. This Agreement is subject to Romanian law. Any disputes arising between CORAL-FARM and Clients/Buyers will be resolved amicably or, if this is not possible, the disputes will be settled by the competent Romanian courts in Ilfov County.
